Attorney Referral Boards

One way to address how to find a good family law attorney is by utilizing a lawyer referral service. There are many of these online, and they’re easy to find. These organizations take one’s information and place it into their databases. Such information includes one’s name, city, and the legal issue. Once that data is inputted, the referral service will select the names of several family law attorneys. From there, it is up to the family to interview each one.

Law School Libraries

Many people wouldn’t think of this to find a family law attorney, but a law school’s library is full of paralegals and law students who work for lawyers. They get to know what each barrister’s specialty is and which ones are effective. They can offer opinions that can really help narrow down the field of lawyers one is looking at. Find out from them which attorneys they work for and if they enjoy working for them. The responses one gets can indicate the basic character of these barristers, so take them under advisement.

In the aftermath of a California divorce, newly single spouses can go through a wide range of emotions. Some feel relieved and motivated to start their new lives as single people. Others go through a period of sadness and remorse, and have a hard time viewing the future in a positive light. Many spouses emerge from divorce with a financial windfall, whether from selling shared property or from other aspects of the property division process.

The manner in which one handles this money can be life-altering. On the one hand, wisely investing these proceeds can help build a foundation for future financial stability, and is the savviest move that can be made. However, many individuals make poor decisions in the months following a divorce settlement, and risk losing money by spending geared toward self-soothing.

Self-soothing is an activity undertaken by all humans. It is what drives babies to use a pacifier and college students to wear a ‘lucky’ shirt for exams. However, self-soothing is also what drives alcoholics to drink, and can lead to irresponsible spending when an individual experiences emotional trauma following a divorce. Regardless of whether one’s poison lies in new shoes, expensive vacations or home remodeling projects, recklessly spending money from a divorce settlement is never a good financial move.

The first step in avoiding this type of issue is to sit down and determine how one wishes their money to serve their current and future needs. By setting goals and envisioning future plans, individuals can make decisions that serve those interests, and not spend on frivolous items that can only undermine progress toward those goals. If a spouse has not taken advantage of the services of a financial planner during their California divorce, the timeframe following the settlement is an excellent time to do so.

Many people feel that they have taken the first step towards a new life when they schedule their first meeting with their family law attorney.  It can be a nerve-wracking experience and someone may feel nervous at the onset of a divorce or custody case.  Television shows and movies play up the “drama” of contested courtroom battles.  Sometimes these fictional stories mimic reality, but the vast majority of cases can be settled relatively amicably.  Regardless of a case’s path, your first meeting with your family law attorney is important.
family-law-attorney
At the first meeting, you and your attorney will discuss your goals for the case.  You should spend some time before the meeting thinking about your goals.  It is helpful to make a list and bring it to your meeting so you do not forget to tell your attorney any important points.  Your attorney can also help you develop your goals after you are more informed about the law and your situation.  One good way to save money in your case is to determine your goals early in your case.  You may incur more attorneys’ fees if you take one position, but change it at a later date because your attorney may need to change his or her litigation strategy.

If you will be involved in a divorce or custody action, your financial information will be very important.  You should save your earnings statements/pay stubs, financial statements, such as credit card statements, bank records, mortgage statements, etc.  These documents are often requested during a divorce or custody case, and you can save time and money if you are able to produce them right away, rather than having to search high and low for a document you might have thrown away.  You should bring these to your first meeting with your attorney.

Being organized in your divorce or custody case is essential.  If you are not a naturally organized person, now is the time to develop good organization skills.  Your attorney should keep track of deadlines, but it is also your responsibility to be aware of what you need to do in order to comply with these deadlines.  You will likely be informed in writing of any deadlines you need to meet.  You will receive copies of important documents and letters, and you should have a secure place to store these documents.  Consider buying an “accordion” folder with many pockets that will be solely devoted to your divorce or custody case.  You should have this folder by the first meeting with your attorney because he or she will likely give you papers to take home that day.  You should also maintain either a paper or electronic calendar so you can keep track of court dates and deadlines.

Being involved in litigation is not a passive experience.  Your attorney is there to help you through the process, and you must also do what you can to help your case succeed by carefully considering your attorneys’ advice.

You are a good person, but you just made a really dumb mistake. It had started out innocently enough. You and your friends went to Mobile, Alabama, and hung out. Towards the end of the day, you went to dinner and reminisced about the good old days. You had a few drinks and then it was time to go home. Unfortunately, you were drunk. You didn’t know it, but the other drivers around you did. They watched you swerve in and out of your lane and called the police. Now you are sitting in jail wondering what happened. Fortunately, there is an excellent Mobile DUI attorney out there for you to hire.

DUI defense attorneyWhat Happens Now?

It is important to remember that just because you drove drunk doesn’t mean you are a bad person. Everybody makes mistakes in their life. Unfortunately you won’t be able to escape the consequences of your actions. DUI is a very serious crime that is usually prosecuted very aggressively. If you are convicted, you are looking at having your car impounded and your driver’s license revoked. You will most likely be facing thousands of dollars in fines and possibly even jail time. If this was your first offense, and if nobody was hurt or killed because of your actions, then the judge might be sympathetic and simply give you probation or community service. Those are the legal consequences you are facing, but there will also be personal ramifications as well. It might take people a while not to look at you as that guy who drove drunk. Your employer might even decide to fire you because you are a convicted criminal.

How an Attorney Can Help

Many of these consequences can be avoided if you call an attorney. He or she will work with the judge and prosecutor to negotiate a plea bargain that most likely will keep you out of jail and possibly even help you to avoid serious consequences altogether. You won’t get this treatment if you try to do it alone or if you hire the wrong attorney. Your attorney might not be able to do anything about the fines or revoked license, but at least you won’t have to stay in jail for a few months.

Don’t Ever Drive Drunk Again

From now on, remember to always choose a designated driver or have someone call you a cab. If you don’t learn from your mistake, then the next time there might not be anything that your Mobile DUI attorney can do for you.

As I have written about on several occasions I often find myself in court rooms, in fact I am in court almost every day.  Even though I have attorneys that work for me I still prefer to handle my clients’ cases personally.
DUI-defence-attorney
Every day I see people showing up at court on very serious charges – such as a DUI/OVI – without representation.  If you have been charged with any crime, let alone one that can change your life, you need to hire an experienced attorney to defend you.

On your very first DUI you can face up to a minimum of six days in jail, the restricted plates (also known as the party plates), high fines, and the loss of your license for up to three full years.

Many people hear stories about people that have gone in and “thrown themselves on the mercy of the court” and had the judge throw out the charges or reduce them.  Unfortunately, some people believe this to be the case and end up getting themselves in even more trouble.

Just today I sat in court and I watched a registered nurse plea no contest, she had refused the breath test so she faced a minimum of six days in jail.  After her plea the judge asked her if she had anything to say on her own behalf.  She talked about her job, her children, and her family.  The judge completely sympathized with her but then sentenced her to six consecutive days in jail, a one year license suspension, the party plates, and the interlock device that goes into your car.  He gave her the absolute minimums that the law allowed him to do.

Do not make the same mistake that this woman made, and many other people make each and every day.  Hire the best that you can afford.

If you would like to learn more about what we can do for you call me at (440) 471-7811.  Ask to speak to me, Joseph Patituce, I am a Cleveland OVI Lawyer who represents people all across the state in serious criminal cases.  If I agree to take your matter on I promise that my team and I will treat it with the seriousness and respect that you deserve.

The attorneys at Beauchamp Law Office P.C. are always saddened to hear of the loss of life in a DUI related accident. Unfortunately, it is not uncommon for DUI related accidents to result in death or serious injury. Even if you are not injured in the DUI accident, we understand the great impact DUI charges can have on a person.

Arizona has some of the harshest DUI laws in the Country. Under Arizona law, a person arrested for DUI may face fines, driver’s license suspension, mandatory ignition interlock device, community restitution and jail time.

If you have been arrested for driving under the influence of alcohol or drugs, you need an experienced DUI attorney. Even if you believe you cannot afford an attorney, the reality is, if you have been arrested for DUI in Arizona, you cannot afford NOT to hire an experienced DUI attorney. But, when you are looking for an attorney, keep in mind that not all DUI attorneys are the same.

That said, here are a few things to remember when searching for a DUI lawyer:

(1)  Arizona does not mandate the amount a DUI attorney can charge for his/her services. Therefore, you are likely to receive quotes that vary significantly. On the bright side, in a large city, you are likely to find an experienced and affordable DUI attorney.

(2)  Attorney’s fees may not be a fair indication of the attorney’s ability, competence or experience in representing clients charged of DUI. Oftentimes, small or mid-sized firms offer excellent DUI representation at a lesser cost than larger firms simply because the operating costs associated with a small firm are generally less than those at a large firm.

(3)  DUI attorneys are prohibited, by the Arizona State Bar, from charging clients based on the outcome of the case; otherwise known as a contingency fee.

(4)  Arizona DUI lawyers are required to disclose to their clients the fees charged and the basis on which those fees are charged. Prior to signing the “fee agreement” make certain that you understand the document and retain a copy of the document for your own records.

(5)  It is not unusual for a DUI attorney to charge the client for the cost of additional services such as an expert witness or psychological assessments.  We recommend speaking openly with your attorney about these potential costs from the beginning.

(6)  Be cautious when reading online reviews posted about a law firm as these may not be always be accurate.

The DUI lawyers at Beauchamp Law Office P.C. understand you have many options when it comes to hiring a DUI attorney. Should you choose to work with the attorneys at Beauchamp Law Office P.C., we will provide you with an experienced and aggressive DUI defense.

Divorce can be costly whether the breakup is amicable or contested. Proceedings can be so exhausting and emotionally draining that many couples are so eager to end them that they make costly mistakes that hurt them financially and create further family law troubles.

During divorce, parents often overspend on their children out of guilt and to try to buy their children’s affections, although much of it unconsciously. Parents can avoid this by constantly talking with their children. What kids really want from parents in such a stressful period is to spend time with them. In effect, quality communication and quality time always trumps trying to buy children’s approval. The extra communication will also be beneficial when dealing with issues of child custody and relocation.

When it comes to alimony and child-support payments, the best strategy is to know one’s actual worth. Make copies of all federal and state tax returns for the last five years to get the best sense of total net worth, including property, investments and other assets. Keeping close tabs on both taxes and assets can be beneficial when it comes to determining child-support payments, alimony payments and equitably dividing assets.

Lastly, being realistic about one’s financial future requires a sober appraisal of how one will derive income, whether from remaining in the workforce or relying on a former spouse’s income or retirement. Most individuals’ financial status and lifestyles change after divorce. That’s why it’s wiser for people to be proactive when planning their financial future — they should always consider how decisions will affect them in the long run.

A couple’s strained relationship during divorce can easily fuel disputes when property and finances are involved. But being aware of people’s rights under Texas law may help alleviate some of the anxiety of divorce proceedings.

When preparing to dissolve a marriage that will involve the best interests of minor children, it is a good idea to hire a competent family law attorney to guide you through the divorce process. Divorce within a family is typically a rather difficult time for everyone that is involved. In such a difficult time, it is extremely wise to have a competent family lawyer to assist you in understanding what needs to be attended to regarding legal issues.
Family-law
Some things that an attorney will help you with pertain to division of marital assets, plus determining how child visitation and child support issues will be handled. Only attorneys that are well versed in family law can adequately help you determine everything that must be considered in a divorce that concerns a family.

You will need to spend some time determining who to retain to represent your legal needs when facing a divorce situation. Keep your search limited to looking only for an attorney that is well versed in both divorce law and family law issues. You will also want to hire only a family law lawyer that has been practicing in this field for many years.

Having a lawyer that practices divorce and family law within the county where you will file for your divorce can also be very helpful. Different states have very different laws in place as well.

You might consider asking friends and family in your area for recommendations. It could also be a good idea to check with the local bar association officials in your area.

Make sure you interview your potential legal counsel before deciding for certain that they will be the right choice for your particular case. See if they will have enough time to properly oversee your case and that you will have adequate attention throughout the divorce process. If you are not comfortable with an attorney, then you should probably keep looking until you find a good attorney that you are also comfortable around. Make certain that you feel confident in your legal counsel and are comfortable talking to them when your emotions may be a little charged at times. By taking these ideas and putting them into practice, you should feel much better about going through a divorce situation. Getting the best possible legal representation when going through a divorce situation involving a family with children is always a very important decision that should take a considerable amount of time, which is well spent. Make your selection carefully and take your time when finding competent legal representation.

After a fun evening out on the town with friends, the last thing you likely expect is to see bright blue flashing lights trailing behind you. Imagine that you are returning home and as you turn onto a familiar street, the blue lights become visible in your rear view mirror.
Orlando DUI attorney
You panic. You have had too much to drink that evening and you suddenly worry about how the cop may respond. The cop exits his vehicle and marches up to your window. He requests that you take a breath test and eventually arrests you for a DUI. When it comes to dealing with such a serious charge, you will need the assistance of an expert legal official who can provide the expertise you need in order to receive a lighter penalty.

A DUI attorney  can be just the professional you need. From providing expert knowledge about the law to assisting you with court proceedings, your lawyer can become a lifesaver when you face the penalties associated with a DUI offense.
Providing Knowledge of Complex Laws

First of all, DUI attorneys can offer you expert advice and knowledge concerning complex DUI laws. Unless you have studied the law extensively, then you likely lack the knowledge that you need to fully understand how to proceed when faced with such a misdemeanor or felony charge. A DUI lawyer stays up-to-date on the latest regulations associated with DUI offenses. In most cases, the truly talented DUI attorneys even work to reform these laws and to change legislation.
Understanding the Various Sobriety Tests

In addition, lawyers that work with cases concerning DUI charges also have a vast knowledge of various sobriety tests. They can counter field sobriety and breath tests because they have likely taken the same classes that many law enforcement officials also had to take. Your lawyer can use this knowledge to your advantage and help you during court proceedings.
Helping You Enjoy a Lesser Sentence

Finally, a DUI charge is not like a traffic ticket. This charge is much more severe, whether it is just a misdemeanor or a felony charge. Also, a DUI stays on your permanent record. A second violation could even mean permanent suspension of your license. As a result, you will need the help of a legal professional who understands the minimums and maximums in place that affect the severity of DUI sentences.

People in Wisconsin may have heard about a new law that could have dangerous consequences for people facing drug or other criminal charges. Wisconsin Act 285, which went into effect last April, allows prosecutors to use hearsay evidence, evidence that is not valid or trustworthy enough to use at a criminal trial, in the preliminary hearing to determine whether there is enough evidence to show that there is probable cause to believe the defendant committed the crime.
drug defense attorney
In this case a 24-year-old man was charged with first-degree reckless homicide in the drug overdose death of his girlfriend. He stood accused of supplying her with the heroin that killed her on April 12, 2012 which, according to prosecutors, is a felony more serious than even drug distribution, even though she willfully took the drugs herself.

In the preliminary hearing the prosecutor attempted to use hearsay evidence, asking a police officer what he heard somebody else say about the alleged events that took place around the time of the woman’s death. This evidence would certainly not be admissible at trial, and thanks to some quick thinking, the defendant’s attorney was able to exclude the officer’s testimony from admission on the grounds that the defendant’s actions took place before the passage of Wisconsin Act 285. By stopping the admission of this evidence, the defense attorney may have saved the man from possibly going through an expensive and arduous criminal trial or possibly spending time in prison.

Criminal defendants in Wisconsin need expert legal representation at every step of the process. Wisconsin Act 285 can make it harder for criminal defendants to get a fair shake in court, which is why people who stand accused of drug possession or other crimes need the counsel of an experienced defense attorney from the very start.
